Terms of service
Effective September 9, 2026
These terms cover two things: your use of windbreaksecurity.com, and the general terms for WindBreak Security's managed security services. Customers also sign a service agreement that sets out plan details, pricing and service levels. Where the two differ, the signed agreement wins.
1. Using this website
You may use this website to learn about our services and to contact us. You agree not to attempt to gain unauthorized access to any part of the site or its infrastructure, interfere with its operation, or use it to send unsolicited messages. Security researchers acting in good faith should follow our responsible disclosure process.
Content on this site is owned by WindBreak Security or its licensors. You may view and print it for your own reference. You may not republish it without our written permission.
The site is provided as is. We aim to keep it accurate and available, but we don't guarantee either, and information here isn't a substitute for advice specific to your situation.
2. Our services
WindBreak provides managed security services, including detection and response, endpoint protection, email security, identity protection, backup and recovery, vulnerability management, security awareness and compliance reporting, as described on our services page and in your service agreement.
We deliver services using our own staff and a small number of vendors. We remain responsible to you for the service as a whole.
3. What we need from you
- Accurate information about your environment, and prompt notice when it changes materially (new sites, systems or a large change in headcount).
- The access described in your agreement and our trust center, and not revoking it without telling us. If access is removed, we'll tell you what protection stops.
- A named contact we can reach for urgent decisions, and a deputy.
- Cooperation during incidents, including following reasonable instructions to contain a threat.
- Using the services only for your own business and in compliance with applicable law.
4. Fees and payment
Fees are set out in your agreement and billed per user, monthly or annually in advance. Invoices are due within 30 days. We may suspend service for accounts more than 30 days overdue after giving you written notice. Prices may change at renewal with at least 60 days' notice.
5. Term and cancellation
Monthly plans continue until either party gives 30 days' written notice. Annual plans run for the term and then renew annually unless either party gives 30 days' notice before renewal. On cancellation we'll remove our agents, hand back administrative control, return your backup data on request, and delete the data we hold within 30 days.
Either party may end the agreement immediately if the other materially breaches it and doesn't fix the breach within 30 days of written notice.
6. What we can and can't promise
Security is about reducing risk, not eliminating it. We will deliver the services with reasonable skill and care, in line with good industry practice and the service levels in your agreement. We don't promise that no attack will ever succeed, and we aren't responsible for losses caused by attacks we couldn't reasonably have detected or prevented, by systems outside the scope of the services, or by your failure to follow our reasonable instructions.
7. Liability
To the extent permitted by law, neither party is liable to the other for indirect or consequential losses, including lost profits or lost data, arising from the agreement. Each party's total liability in any 12-month period is limited to the fees paid by you for the services in that period. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or anything that can't be limited by law.
8. Confidentiality and data
Each party will keep the other's confidential information confidential and use it only for the purposes of the agreement. We process personal data on your behalf under our data processing terms and our privacy policy. You confirm you have the right to give us the access we need, including any notices to your staff that the law requires.
9. Intellectual property
We keep ownership of our tools, processes, reports templates and know-how. You keep ownership of your data. You may use the reports we produce for your business, including sharing them with insurers, auditors and clients.
10. Changes to these terms
We may update these website terms from time to time by posting the new version here. Changes to service terms for customers take effect at your next renewal, or earlier with your written agreement.
11. Governing law
These terms are governed by the laws of the State of Delaware, United States, and any dispute will be resolved in its courts, unless your service agreement says otherwise.
